Since becoming the Attorney General, John Ashcroft has
pursued policies that have divided the country. The failure of John
Ashcroft's leadership of the department of justice and misdirection of the
Federal Bureau of Investigation was demonstrated on September 11, 2001. (See
below)
John Ashcroft has infringed on civil liberties with many
actions. From reviving the practice of racial profiling, to detaining
citizens and non-citizens alike indefinitely without charges, to entering
our homes without probable cause, John Ashcroft is a danger to democracy and
the Constitution.

The Management of FBI and Department of Justice
failed to do their job on 9-11-2003 on John Ashcroft’s watch:
‘The
Phoenix Electronic Communication
5.e. On July 10, 2001, an FBI Phoenix field office agent sent an
"Electronic Communication" to 4 individuals in the Radical
Fundamentalist Unit (RFU) and two people in the Usama Bin Ladin Unit (UBLU)
at FBI headquarters, and to two agents on International Terrorism
squads in the New York Field Office. In the communication, the agent
expressed his concerns, based on his first-hand knowledge, that there
was a coordinated effort underway by Bin Ladin to send students to the
United States for civil aviation-related training. He noted that there
was an "inordinate number of individuals of investigative interest" in
this type of training in Arizona and expressed his suspicion that this
was an effort to establish a cadre of individuals in civil aviation
who would conduct future terrorist activity. The Phoenix EC requested
that FBI Headquarters consider implementing four recommendations:

accumulate a list of
civil aviation university/colleges around the country;

establish liaison with
these schools;
-
discuss the theories
contained in the Phoenix EC with the Intelligence Community; and
-
consider seeking
authority to obtain visa information concerning individuals seeking
to attend flight schools.
However, the FBI headquarters personnel did not take the action
requested by the Phoenix agent prior to September 11, 2001. The
communication generated little or no interest at either FBI
Headquarters or the FBI’s New York field office. ‘

| Ashcroft and the
Constitution Attorney General John Ashcroft and his staff were the prime movers
and writers of the Patriot Act, the provisions of which he has pushed
hard. Mr. Ashcroft has argued that the government has the right to
seize records and compel testimony in terrorism cases without prior
review by a court or grand jury. He urged the denial of bail, without
proving danger or flight risk, for a laundry list of federal crimes
said to be terrorism-related.
He has expanded the use of the death penalty for crimes of
"domestic terrorism". The Patriot Act gives a definition so broad that
it can and Ashcroft has threatened to use it to cover acts of civil
disobedience by protest groups. He has sanctioned the imprisonment of
Afghan rebels in Cuba without placing real charges against them,
refusing to bring them to trial. Many are being held simply because
they were in the wrong place or had a suspicious-sounding last name.
He continues to support "sneak and peek" searches, which allow the
FBI to secretly access all private records of any American. He has
undermined the First Amendment by opposing any objective definition of
domestic terrorism. In effect, anyone can be and has been charged as a
terrorist. He instituted a new immigrant tracking programs, U.S.
Visit, in addition to the National Security Entry-Exit Registration
that singles out Arab and Muslim men because of their national origins
and subjecting them to special and confusing requirements. |

The Constitution: Unreasonable Searches, Due
Process, Speedy and Public Trial
Amendment IV
The right of the people to be secure in their persons, houses,
papers, and effects, against unreasonable searches and seizures,
shall not be violated, and no warrants shall issue, but upon
probable cause, supported by oath or affirmation, and particularly
describing the place to be searched, and the persons or things to be
seized.
Amendment V
No person shall be held to answer for a capital, or otherwise
infamous crime, unless on a presentment or indictment of a grand
jury, except in cases arising in the land or naval forces, or in the
militia, when in actual service in time of war or public danger; nor
shall any person be subject for the same offense to be twice put in
jeopardy of life or limb; nor shall be compelled in any criminal
case to be a witness against himself, nor be deprived of life,
liberty, or property, without due process of law; nor shall private
property be taken for public use, without just compensation.
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right
to a speedy and public trial, by an impartial jury of the state and
district wherein the crime shall have been committed, which district
shall have been previously ascertained by law, and to be informed of
the nature and cause of the accusation; to be confronted with the
witnesses against him; to have compulsory process for obtaining
witnesses in his favor, and to have the assistance of counsel for
